These Terms of Service (“Terms”) are a binding agreement between you and PL8CHAT, Inc. governing your use of our websites, mobile applications, and related services (the “App”). By using PL8CHAT, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
To create a PL8CHAT account for a vehicle, you must be the registered owner of that vehicle. By creating an account, you confirm that your information is accurate and that you are authorized to use PL8CHAT. Businesses must provide accurate company details and ensure the person creating the account is authorized to act on their behalf.
2. Accounts and Verification
To use certain features, you must create an account with your name, email, password, and phone number. You may be asked to verify your identity or vehicle by providing a government-issued ID, selfie, license plate, and vehicle registration. You are responsible for your account and all activity under it.
3. Privacy
Your use of PL8CHAT is also governed by our Privacy Policy.
4. User Content
You retain ownership of content you submit. By submitting content, you grant PL8CHAT a worldwide, non-exclusive, royalty-free license to use it to operate and improve the App. You are responsible for your content and must have the rights to share it.
5. User Conduct
You agree not to use PL8CHAT in ways that are unlawful, unsafe, harassing, misleading, or harmful. This includes misuse while operating a vehicle, impersonation, unauthorized access, unauthorized commercial use, or sending abusive or threatening messages. We may suspend or remove accounts that violate these Terms.
6. User Interactions
You are responsible for your interactions with others. We do not screen users and are not responsible for user behavior. Do not use the App while driving and follow all traffic laws.
7. Business Use
Businesses use PL8CHAT at their own discretion and are responsible for their communications and compliance with applicable laws.
8. Reports and Platform Limitations
PL8CHAT provides communication and reporting tools only. Reports may be incomplete, inaccurate, delayed, or unverified. We do not guarantee accuracy or that all incidents will be reported. We may review, filter, or remove content that violates our policies. Businesses are responsible for how they interpret and act on information.
9. Reporter Privacy
When a report is submitted through the website, no personal information is shared unless the reporter provides an email address. If provided, that email may be shared with the recipient. When submitted through the mobile app, the recipient sees only the reporter's display name and associated license plate. Other personal information is not shared. Users can control how they are contacted, including disabling direct messages and receiving alerts only.
10. Physical Materials
PL8CHAT may provide decals or license plate frames. These are provided as is. You are responsible for proper use, placement, and compliance with laws.
11. Payments
Some features may require payment. Purchases are final once fulfilled, though we may offer refunds or replacements at our discretion. Pricing and terms may change.
12. Intellectual Property
All rights in the App, including design and branding, belong to PL8CHAT. You may not copy or use them without permission.
13. Third-Party Services
The App may include third-party services. We are not responsible for their availability or practices.
14. Availability
We do not guarantee the App will be available at all times or without interruption.
15. Disclaimer
PL8CHAT is provided as is without warranties of any kind. We do not guarantee accuracy, reliability, or outcomes.
16. Limitation of Liability
To the fullest extent permitted by law, PL8CHAT is not liable for any damages related to your use of the App. This includes reliance on reports, user interactions, business decisions, missed or inaccurate information, or any related incidents or damages.
17. Indemnification
You agree to indemnify and hold PL8CHAT harmless from any claims or damages arising from your use of the App or violation of these Terms.
18. Enforcement
We may remove content, restrict access, or suspend accounts that violate these Terms or create unsafe conditions. Serious violations may be referred to law enforcement.
19. Disputes
Disputes will be resolved through binding arbitration. You waive the right to participate in class actions.
20. Changes
We may update these Terms. Continued use of PL8CHAT means you accept any changes.
21. Feedback
Any feedback you provide may be used by PL8CHAT without restriction or compensation.
22. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes not subject to arbitration will be resolved in Orange County, California.
23. Emergency Use
PL8CHAT is not an emergency service. Do not use it to report emergencies.
24. No Duty to Monitor
We are not required to monitor activity on the App but may do so at our discretion.
25. Communications
Messages and reports are created by users. We do not verify or endorse their accuracy.
26. Service Scope
PL8CHAT provides a communication layer only. We do not provide insurance, guarantees, or enforcement.
27. Account Termination
We may suspend or terminate accounts at any time for misuse or violations.
28. Compliance
You are responsible for complying with all applicable laws when using PL8CHAT.
